ARRIVAL AND DEPARTURE TIMES
The lease begins at 3 pm the "Checkin date" and ends at 12 noon on the "Checkout date".
Any late departure shall give rise to the payment of an additional night and may be refused by the Agency.
Unless stated otherwise, the maximum number of guests is limited to 2 persons per bedroom.
The number of guests in the property cannot exceed this maximum number of guests authorized for the stay, at any time during the rental. This does not apply to relatives and friends visiting but not staying overnight.
Should the number of guests be less than that for which the reservation has been confirmed, no adjustment of the rental shall be made by the Agency.
The Customer and the occupants for whom the Customer acts as guarantor undertake to occupy the property leased in a peaceful manner (respect for neighbours, proper use of all the equipments and furniture of the house, etc) and not to cause any damage therein.
Any subletting is forbidden.
All given rates are in USD and exclude tourism tax.
A minimum stay of 7 nights is request, shorter stays are on request.
All bookings that include Christmas Day or New Years Day will be charged at the Festive Season rate and for a minimum of 14 days, shorter stays are on request.
Rates may be subject to change without notice.
No booking fees but if the client pay in CB or AMEX, 2% fees are applicable (bank fees).
A deposit of 25% of the gross rental cost is due to confirm your reservation (30% for Premium Villas) . When booking online we will take an authorization on your credit card.
After confirming that the owner of the property has accepted your reservation we will send your reservation confirmation. It’s only after this confirmation that we will process the payment on your credit card. You can pay by bank transfer is you prefer.
Balance payment (if applicable) will be due 30 days prior to the Checkin date (45 days for Premium Villas) or 60 days prior to the Checkin date for the Christmas/New Year Holidays (and 90 days for Premium Villas).
If the balance payment is not received 30 days prior to the Checkin date (45 days for Premium Villas) or 60 days for the Christmas/ New Year Holidays (90 days for Premium Villas), the Agency reserves the right to cancel the booking. This cancellation shall result in the loss of the deposit by the Customer.
For reservations made less than 30 days prior to the Checkin date (45 days for Premium Villas) or 60 days for the Christmas/ New Year Holidays (90 days for Premium Villas) , the Customer shall pay the total amount of the lease at the time of the reservation.
CANCELLATION BY THE CLIENT
A planned stay in low and high season:
More than 30 days before the arrival date: the deposit of 25% of the total rental price is retained.
PREMIUM VILLAS : More than 45 days before the arrival date : the deposit of 30% of the total rental price is retained
Less than 30 days: no refund is made to the tenant.
PREMIUM VILLAS : Less than 45 days : no refund is made to the tenant.
A stay planned for the Christmas - New Year period:
More than 60 days before the arrival date: the deposit of 25% of the total rental price is retained.
PREMIUM VILLAS : More than 90 days before the arrival date : the deposit of 30% of the total rental price is retained
Less than 60 days: no refund is made to the tenant.
PREMIUM VILLAS : Less than 90 days : no refund is made to the tenant.
However, if the owner accepts, the amount of the deposit may be transferred to a future rental within one year of the date of the initial reservation.
Cancellation insurance: It is in the customer's interest to insure against rental risks and to guarantee the legitimate grounds for termination, in particular due to illness or accident for example. The customer recognizes that it is his personal business.
Villa changes while the Client is on the island are not permitted except for a justifiable cause such as loud construction, or a major technical problem in the villa. All of these changes are made at ST BARTH DREAM VILLA ’s best judgment.
CANCELLATION BY ST BARTH DREAM VILLA
Though it is unlikely that ST BARTH DREAM VILLA will have to make any changes to confirmed arrangements, it does occasionally happen for reasons beyond SBDV control. SBDV will advise the client at the earliest possible date. If for any reason beyond its control, SBDV is unable to provide the Client with the property that he has booked, SBDV reserved the right to transfer the Client to a similar villa.
However, if it's not possible or if the Client does not wish to be transferred, SBDV will cancel the booking and refund the amount paid to SBDV for the villa. SBDV will not liable for any cancellation charges for travel arrangements.
On checkin date, the Customer will be asked to sign a Credit Card Authorization form.
This credit card will be used to cover:
damage to the property or furnishings;
dirt or other mess requiring excessive cleaning;
or any other cost incurred by Homeowner due to Guest’s stay.
A 500$ authorization will be taken on this credit card and cancelled 3 days after the Customer departure at the latest.
The Guest will not be allowed access to the property without presenting a credit card and signing the authorization form.
In the event of damage to the property and/or in the event the Customer's account should be debited, the Customer expressly gives authorization to the Agency to debit his/her credit card to cover the repairs necessary pursuant to this rental and/or the costs incurred by the Agency on behalf of the Customer.
A 5% processing fee will be added to the costs incurred.
If the premises appear dirty or damaged upon Checkin, Guest shall inform Manager immediately.
Unless stated otherwise, daily housekeeping (excepts on Sundays and Public holidays) is included in the rental rate.
LIABILITY FOR OBJECTS AND PERSONAL EFFECTS
The objects and personal effects of the Customer and the other guests remain under their own responsability.
Valuables must be placed by the Customer and the other guests in the safes envisaged for this purpose.
Neither the Agency nor the Owner shall be held liable in the event of loss, damage to or theft of the said objects and effects.
The Customer undertakes to take his/her own insurance covering the risks relating to his/her trip and his/her stay (cancellation of flight, lateness, loss of luggages,etc)
The Agency shall not in any way be held liable in the event of problems such as cancellation of flight, lateness, loss of luggage, etc (this list not being exhaustive).
Any complaints of the Customer that may arise during his/her stay must be sent immediately to the Agency.
Any complaint sent after the departure of the Customer shall be deemed to be late and shall not be taken into account by the Agency.
This contract is exclusively governed by French law.
For any dispute resulting from the interpretation, performance or termination of this contract, jurisdiction is expressly attributed to the BasseTerre District Court (Guadeloupe).
